The Hyperliquid Policy Center has urged the U.S. Securities and Exchange Commission to adopt its proposed Regulation Crypto Assets rules with five specific refinements, according to reports by The Block and Crypto Briefing. In its comment letter, the advocacy group expressed support for the regulatory initiative while calling for adjustments to address practical hurdles faced by Web3 developers.[1][2][3]

The SEC's framework proposes exemptions permitting startup token offerings of up to $5 million over four years and qualifying fundraising rounds of up to $75 million across any 12-month period, while offering relief from state-by-state registration requirements. It also introduces a safe harbor intended to confirm when a digital token no longer depends on its original developers and is no longer tied to an investment contract.[2][3]

HPC warned that many crypto projects cannot satisfy the proposed safe harbor in its current form and requested expanded, clarified safe harbor provisions. The group also asked regulators to establish clearer guidance on free token airdrops, arguing that administrative steps completed by recipients to collect airdropped tokens should not be treated as payment. Additionally, HPC urged the SEC to allow broader secondary market trading for exempt tokens and establish clearer guidelines for automated token buybacks.[1][2][3][4]
