Democrats win House and Senate majorities as crypto and AI sectors brace for scrutiny
Democrats secured control of both chambers of Congress in the 2026 midterm elections, dealing a blow to major crypto political spending and setting up heightened regulatory oversight for the digital asset and tech sectors.

Democrats have won control of both the House of Representatives and the Senate in the 2026 midterm elections, breaking unified Republican control across government branches, according to reports citing the Associated Press. Cointelegraph reported that Josh Turek's Iowa victory handed Democrats the Senate majority, with latest counts showing Democrats securing 54 Senate seats and 225 House seats.[3][5][7][8]
The election delivered severe setbacks to political operations mounted by crypto political action committees. Democrat Sherrod Brown defeated Republican Jon Husted in the Ohio Senate race despite heavy crypto industry opposition, which Politico placed at more than $55 million, CoinDesk reported at roughly $63 million, Eleanor Terrett tallied at over $64 million, and Reuters reported topped $68 million. Pro-crypto Republican Representatives Bryan Steil, Zach Nunn, and Ann Wagner also lost their House seats, though pro-crypto candidates Pete Ricketts and Andy Barr won Senate seats in Nebraska and Kentucky.[1][2][4][6]
The power shift creates substantial headwinds for the digital asset agenda, specifically the CLARITY Act, which already failed a Senate procedural vote in September by 50 to 49. Politico reported that Senator Elizabeth Warren appears poised to lead the Senate Banking Committee, while Maxine Waters could assume greater oversight in the House. Lawmakers are also expected to scrutinize President Donald Trump's crypto ventures, which Reuters estimates have generated at least $2.3 billion in profits.[1][4][7][11]
Broader financial markets erased initial overnight losses, with major U.S. stock futures rebounding into positive territory, while Bitcoin traded up near $78,200 and Ether around $2,320. Meanwhile, the AI sector faces expanding pressure over power consumption and the environmental footprint of data centers, leading Elon Musk to post on X that data centers in space are 'looking pretty appealing right now.'[2][4][9][10]

Democrats Sweep Congress as Sherrod Brown Survives Crypto’s Ohio Spending Push Democrats won control of both the House and the Senate in Tuesday’s midterm elections, the Associated Press reported, handing the committees that oversee crypto to the party whose senators blocked the industry’s market structure bill this session. In Ohio, Democrat Sherrod Brown beat Republican Sen. Jon Husted despite heavy crypto spending against him. Politico put the industry’s outlay on the race at more than $55 million , while Reuters reported before the vote that the figure topped $68 million . The Fairshake super PAC network had spent more than $40 million to unseat Brown in 2024, when he chaired the Senate Banking Committee, according to Politico. Sen. Elizabeth Warren (D-Mass.), who has long pushed for tighter crypto oversight, “appears poised” to chair Senate Banking, Politico reported . One industry lobbyist, granted anonymity by Politico, called it “an awful night for crypto,” adding, “From a Hill perspective, they are going to be lit on fire against crypto.” Others were less worried. Coinbase Vice President for U.S. Policy Kara Calvert told Politico that “you have a new class coming in that is open and is looking at this,” referring to incoming Democratic freshmen. Grayscale Head of Research Zach Pandl argued last week that a flip in Congress would not materially change crypto’s prospects because the industry is bipartisan, global and institutional. Get Unchained’s crypto news in your inbox with the free Unchained Daily newsletter . A Harder Road for the Clarity Act The Democratic sweep could further reduce the odds of the Clarity Act passing in its current form. Senate Democrats had refused to advance the bill, which would split crypto oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, unless it included stronger language barring Trump, his family and administration officials from profiting from crypto ventures. While the CFTC and SEC have moved to fill the regulatory gap with rules of their own, JPMorgan analysts told Reuters that rules written under President Donald Trump could be undone by a later administration. “The Clarity Act was already stalled so a Democratic Congress will delay it further,” crypto commentator Aaron Bennett wrote on X . AI May Be Next Data centers may also face more scrutiny. In March, Sen. Bernie Sanders and Rep. Alexandria Ocasio-Cortez unveiled a bill to pause large new AI data centers until Congress passes federal AI rules. Franklin Crypto Head Chris Perkins said on Unchained’s Bits + Bips the day before the vote that, heading into the midterms, “that entire industry is in the crosshairs, data centers, et cetera.” Jim Bianco of Bianco Research said on an Oct. 26 episode that Democrats are split between “decelerationists” and labor unions he called “accelerationists.” Solana co-founder Anatoly Yakovenko posted on X “If you are in data centers, pivot to crypto” while Elon Musk , whom AP listed among possible targets of Democratic investigations, wrote on X “Data centers in space looking pretty appealing right now” about two hours later. Lumida CEO Ram Ahluwalia said on the Bits + Bips episode the day before the vote that “if the Dems do take both, I think you get a one and done washout, and that resets where asset prices are.” Related Listen: Why Is Warren Siding With the Banks? Trump's Crypto Agenda Just Lost its Biggest Advantage Donald Trump (@realDonaldTrump) now faces a Democratic-controlled House and Senate for his final two years in office. Democrats have taken control of both chambers of Congress in the 2026 midterm elections, securing 54 Senate seats and 225 House seats, according to latest figures. The result puts Trump's legislative agenda under pressure. Crypto legislation, particularly the stalled CLARITY Act, could face fresh resistance. A Democrat "sweep" puts US stocks in their WORST historical setup. Dems just won control of both the House and the Senate. That’s a big shift. Before this election, Reps ran both. Wall Street didn’t love the news at first. Overnight, stock futures dropped. (Futures are bets on where stocks will open the next day) - Nasdaq 100: -2.4% - S&P 500: -1.4% - Dow: -0.8% But by early morning, all three had erased their losses and turned green: - Nasdaq 100: +0.26% - S&P 500 : +0.33% - Dow: +0.70% So why are investors nervous? 1. Because history shows this setup has been tough for stocks. Since 1951, a Rep president with a Dem Congress has been the worst combo for the S&P 500. Stocks averaged just +4.9% a year under it. 2. Trump stays in the White House until 2029. And under a Rep president, a split Congress averaged +13.7% a year and a full Rep Congress averaged +7.6%. Both are still way BETTER than a full Dem Congress. 3. There's another layer to this: Dems FLIPPED both chambers from Rep control. That has only happened 3 times since 1928. And after each one, stocks went UP the next year: - 1949 under Truman (D): +10.5% - 1955 under Eisenhower (R): +26.4% - 2007 under Bush (R): +3.5% That’s an average gain of +13.5% So where does the “WORST” label come from? Mostly from later years. In 2008, the second year after the 2006 flip, the S&P 500 crashed -38.5% during the Financial Crisis. One caveat: that crash is baked into the +4.9% average. Excluding 2008, it rises to about +7.0%, which is still the weakest setup under a Rep president. The lesson: the first year after a flip has been for stocks every time. The second year is where the TROUBLE has shown up. For this Congress, that means watching 2028 more closely than 2027.
